These Terms & Conditions ("Terms") govern your use of HIYP (the "Service"), a service operated by HIYP, LLC ("HIYP," "we," "us," or "our"). By creating an account, checking the acceptance box at signup, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & parental consent

You must be at least 13 years old to use HIYP. If you are under 18, you must have permission from a parent or legal guardian. Parents or legal guardians who create or link a student account represent that they have legal authority to do so and, for any student under 13, provide verifiable parental consent as required by the Children's Online Privacy Protection Act ("COPPA").

2. Your account

You are responsible for keeping your password secure and for all activity that occurs under your account.
You may not share your account or transfer it to anyone else.
You are responsible for the content you add to the Service, including any information about a linked student.
Notify us promptly at security@hiyp.app if you suspect unauthorized access.

3. Acceptable use

You agree not to:

Use the Service for any unlawful, deceptive, or harmful purpose.
Attempt to access another family's data or bypass authentication, authorization, or other security controls.
Upload malicious code, spam, or content that infringes someone else's rights or violates applicable law.
Reverse engineer, scrape, resell, or create derivative works from the Service, except as expressly permitted by law.
Use the Service in a manner that overburdens infrastructure or interferes with other users.

4. Subscriptions and payments

HIYP is offered as a $24/month membership. Everything is included — four-year capture, reminders, college insights, scholarship matching, and application outline support. You can cancel anytime from the Billing page.

Charges renew monthly until you cancel. Payments are non-refundable except as required by law. Pricing may change for future customers, but will not change for active memberships without prior notice. Payment processing is handled by our third-party payment processor and is subject to their terms.

5. SMS/Text messaging terms

If you opt in to HIYP text reminders, you agree to receive recurring automated account-related text messages from HIYP concerning college-planning tasks, deadlines, saved action items, and other activity associated with your HIYP account.

Message frequency varies. Message and data rates may apply.

Reply STOP to unsubscribe from text messages at any time. Reply HELP for help.

Consent to receive text messages is optional and is not required to use HIYP or purchase a HIYP membership. Wireless carriers are not liable for delayed or undelivered messages.

6. Your content

You retain ownership of the records you add to HIYP. You grant us a limited, worldwide, non-exclusive license to host, store, display, back up, and process that content solely so we can operate the Service for you and your linked family members. You represent that you have all rights necessary to grant this license.

We may use aggregated, de-identified data (from which you and any student cannot reasonably be identified) to operate, secure, and improve the Service. We do not sell your personal information.

7. AI-generated content

HIYP uses artificial intelligence to generate suggestions, outlines, summaries, college insights, scholarship matches, and other content ("AI Output"). AI Output is provided as informational starting points only. It may contain errors, omissions, or outdated information. You are responsible for reviewing, verifying, and editing AI Output before relying on it — especially for deadlines, eligibility requirements, and any statements the student submits to a college, scholarship, or other institution. HIYP does not write, and is not responsible for, admissions essays or applications the student submits.

8. No guarantee — service disclaimers

HIYP is a college-prep guidance and record-keeping tool. It is not a promise of any outcome. You expressly acknowledge and agree that HIYP does not guarantee, and makes no representation or warranty as to:

Admission to any college, university, or program.
Any specific scholarship, financial aid, grant, or award.
Any specific test score, GPA, class rank, or other academic outcome.
Any specific internship, job, summer program, or extracurricular result.
The accuracy or completeness of third-party data (college profiles, deadlines, scholarship listings, etc.).

Admissions, scholarship, and hiring decisions are made solely by the relevant institutions and are outside HIYP's control. HIYP does not provide legal, financial, medical, tax, or licensed counseling advice, and nothing in the Service constitutes such advice. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

9. Security & data-incident acknowledgment

HIYP uses commercially reasonable administrative, technical, and organizational measures to protect your information (including encryption in transit, role-based access controls, and row-level security in our database). However, no online service, transmission, or storage method is 100% secure. You acknowledge that HIYP cannot and does not guarantee absolute security. To the fullest extent permitted by law, you release and hold harmless HIYP and its officers, employees, contractors, and agents from any claims, damages, or losses arising out of or related to unauthorized access to, disclosure of, or loss of your data, except to the extent caused by HIYP's willful misconduct.

10. Limitation of liability

To the fullest extent allowed by law, HIYP and its team are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or educational or professional opportunity, arising from or related to your use of the Service — even if we have been advised of the possibility of such damages. Our total aggregate liability for all claims arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) US $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless HIYP and its team from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

12. Service availability & force majeure

We work hard to keep HIYP reliable, but we do not guarantee uninterrupted access. We may update, modify, or temporarily suspend the Service for maintenance, upgrades, or to address security or legal issues. We are not liable for delays or failures caused by events outside our reasonable control, including internet outages, upstream provider failures, natural disasters, or government actions.

13. Termination

You can stop using the Service at any time. We may suspend or terminate accounts that violate these Terms, that we reasonably believe pose a security or legal risk, or as required by law. Sections that by their nature should survive termination (including 6, 8, 9, 10, 11, 14, and 15) will survive.

14. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. You and HIYP agree to first attempt to resolve any dispute informally by contacting legal@hiyp.app. If we cannot resolve it within 60 days, the dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.

15. Changes to these Terms

We may update these Terms occasionally. Material changes will be announced in-product or by email and may require you to re-accept before continuing to use the Service. Continued use after changes take effect means you accept the updated Terms.
